Finkelstein & Partners and co-counsel secured a landmark $55.7 million settlement on behalf of a Massachusetts couple who endured a prolonged campaign of stalking, intimidation, and harassment carried out by former eBay employees. The retaliation was reportedly triggered by coverage published on the couple’s independent e-commerce news website, EcommerceBytes, and escalated into a coordinated effort that included threatening messages, unwanted deliveries, surveillance, and other disturbing conduct.
After years of litigation, the settlement provides compensation to the couple, while additional funds will support charitable organizations, including efforts dedicated to protecting First Amendment rights. The resolution follows criminal proceedings in which multiple former eBay employees pleaded guilty for their roles in the harassment campaign, and comes after extensive discovery, motion practice, and trial preparation.
According to counsel, the case was about more than financial recovery. It was an effort to uncover the truth, hold those responsible accountable, deter future corporate misconduct, and ensure that others would not have to endure similar treatment. The settlement serves as a powerful reminder that individuals and corporations can be held accountable when misconduct causes significant harm.
Scalli Murphy Law was the first law firm involved in the matter. In 2019, while the harassment campaign was still underway, David and Ina Steiner contacted the firm seeking help. Scalli Murphy Law assisted the Steiners who were ultimately able to involve the Natick police and FBI investigators.
Managing Partner Andrew Finkelstein, Attorney Brian Acard, Attorney Kenneth B. Fromson, and Attorney Lawrence D. Lissauer were part of the legal team representing the couple and their company throughout this complex, multi-year litigation. Finksletein & Partners and Diller Law performed all the litigation and were prepared to try the case, driving the number to a record settlement. Working alongside attorneys from Jacoby & Meyers, Diller Law and Finkelstein Blankinship Frei-Pearson & Garber, the team helped secure a landmark resolution that held those involved accountable and obtained meaningful compensation for the victims. The case is widely regarded as a significant deterrent against corporate retaliation targeting journalists, publishers, and individuals exercising their First Amendment rights.
