$5.5 Million Settlement : Distracted Driver Hits Pedestrian

While working for New York State, a corrections officer was driving through the City of Newburgh looking for a parole violator. As he drove down Ann Street, he was looking to his right for several blocks. Up ahead our client was walking across Ann Street on his way to a breakfast at a local church. Our 61-year-old client made it halfway across the road when he was hit by the front driver’s side of the corrections officer’s personal car. The correction officer never braked and testified he never saw our client before the impact. Since the officer was in the course of his employment, New York State was responsible for all the injuries and damages caused. The impact was so hard our client was thrown six feet in the air and landed on his head. He suffered a traumatic brain injury, and since that time our client has been forced to reside in an assisted living facility.
