An Orange County grand jury has indicted a man from the City of Newburgh on felony charges which include aggravated vehicular homicide, manslaughter and drunken and drugged driving in the car crash that killed his wife. 43 year old Carolyn Rivera-Colon died at St. Luke’s Cornwall Hospital’s Newburgh campus. The indictment charges that Luis Herrera, Carolyn’s husband, had a BAC of .14% and also had marijuana in his system from mid November at the time of the crash. Herrera is faced with multiple counts of aggravated vehicular homicide and first- and second-degree vehicular manslaughter under legal theories of the crash. He is also charged with second-degree manslaughter and criminally negligent homicide on alternate legal theories. He is charged with reckless driving and with speed not reasonable and prudent for conditions. Please don’t drink and drive.
