A construction crew’s failure to safely secure a heavy metal pin on excavator attachment equipment caused it to violently eject and strike our client in the head and face while he worked at a job site in the Village of Clinton, New York. The resulting trauma caused skull and facial fractures along with bleeding on the brain, leaving him with a traumatic brain injury, chronic headaches, and lasting cognitive and vision changes that altered his daily life and ability to work. Our firm pursued this case through years of hard-fought litigation, extensive discovery, multiple depositions of the contractors and municipal witnesses involved, and contested motion practice that survived summary judgment.
