$1,625,000 Million Settlement : Pedestrian Hit while Crossing

While in the crosswalk and crossing Consaul Road in Schenectady, our 32-year-old single client was struck by a driver who failed to yield the right of way to the pedestrian while he was executing a left turn. The initial impact caused blunt trauma to our client’s legs but she did not break any bones. She went to the hospital where she was treated and released. Over the next few days, her legs began severely bruising. Unknowingly, she had developed a clot that traveled to her lungs and caused her immediate death.

As of the writing of this report, the Governor has the Grieving Families Bill that overwhelmingly passed the NY Assembly and the NY State Senate. The law, once signed, will recognize the grief and hardship felt by our client’s Mother and Sister.

However, until the Bill is signed into law, the only recovery available in New York is the three days of pain and suffering she felt. The case was ultimately settled by Managing Partner Andrew Finkelstein and Trial Attorney Jeff Brody.
