Personal Injury
Personal injury victims are injured through the fault
of another person or group. Personal injury encompasses
a broad range of cases, from slip and fall injuries
to automobile accidents. Any case in which one person
is hurt by another person's negligent or wrongful action
(or inaction) may be considered personal injury. Most
personal injuries include physical, emotional, and financial
hardships.
Medical Malpractice
Medical professionals are meant to provide care and
healing, but in cases of medical malpractice the opposite
occurs. When a doctor makes an incorrect diagnosis,
fails to treat a patient's condition promptly, issues
a wrong prescription, or neglects to administer appropriate
care, the patient may suffer serious injury. The victim
and his or her family may be overwhelmed with medical
bills and other costs. In cases of permanent disability,
the victim may never be able to work again. In addition,
victims and their families often endure lasting emotional
pain and suffering.
Dangerous Drugs
Unfortunately, there are many drugs on the market that
are inherently dangerous. Many have not received FDA
approval but are being sold in health food stores by
organic retailers; many more FDA-approved drugs were
not adequately tested for side effects before being
made available to the public. Even if a drug has since
been taken off the shelves, parties who have been injured
by those drugs are still entitled to compensation.
Workers' Compensation
Workers who are injured on the job are entitled to workers'
compensation--regardless of who is at fault for the
accident. Workers' compensation protects workers by
providing for their medical expenses and lost wages.
Products Liability
Manufacturers and store owners have a responsibility
to consumers. They must ensure that the products they
sell are neither defective nor inherently dangerous.
If a dangerous or defective product injures an unwary
consumer, the manufacturer (and sometimes the designer,
distributor, wholesaler, or retailer) is considered
legally liable, as long as the consumer was using the
product as it was meant to be used when he or she was
injured. Whether the product is a hairdryer or an automobile
tire, manufacturers must make sure that products are
designed and made safely, that quality control systems
prevent defective products from entering the market,
and that adequate directions and warning labels are
available to protect consumers.
Motor Vehicle Accidents
The drivers of all types of motor vehicles--cars, trucks,
buses, motorcycles, vans, etc--must abide by laws meant
for safety, including laws that prohibit speeding and
consuming alcohol before or while driving. In addition,
the companies that maintain public transportation vehicles
such as buses are liable for the safety of their vehicles.
All drivers are responsible for their reckless behavior.
Unfortunately, failure to obey traffic laws causes thousands
of accidents, injuries, and deaths each year.
Estate Litigations
The period following death is a difficult time for family
and loved ones. The time is further complicated by an
array of legal issues the deceased’s family is
left facing. Tasks like canceling Social Security payments,
paying estate taxes and informing creditors of the death
are almost always expected. Furthermore, a failure to
attend to these issues can lead to greater complications
down the road.
