CERTIORARI GRANTED: FINKELSTEIN & PARTNERS TO WRITE AMICUS BRIEF TO U.S. SUPREME COURT IN HENDERSON CASE

The Supreme Court will hear the Henderson Case. Finkelstein & Partners will author an amicus brief to the Supreme Court on the issue of equitable tolling and the Veteran’s Claim. As previously reported, many Veterans, due to the disabilities from which they suffer, are unable to understand and/or appreciate an appellate deadline. Mr. Henderson is one such veteran whose appeal with respect to seeking service connected benefits was denied because it was filed late. By deciding to hear the case, the Supreme Court has indicated that the issues raised by Henderson are ripe for its review. It is the hope of many that the Supreme Court will ultimately issue a ruling in Henderson’s favor and afford Veteran’s with disabilities the benefit of equitable tolling with respect to their claims.
